Tziki ("Tziki," "we," "us," or "our") is owned and operated by 209 Tzatziki LLC, located at 209 7th Avenue, New York, NY 10011. We are a Greek souvlaki shop, and we treat your personal information the way we treat our guests: with care and respect.

This Privacy Policy explains how we collect, use, share, and protect your information when you visit our website (tziki.com), order through our online ordering platform, use the Tziki mobile app, join our loyalty program, sign up for our emails or text messages, or visit us in person.

By using our website, app, or services, you agree to the practices described in this Privacy Policy.

1. Information We Collect

Information you provide to us:

  • Contact information — your name, email address, and phone number when you place an order, create an account, join our loyalty program, or sign up for marketing communications.

  • Order information — the items you order, order history, pickup or delivery details, special instructions, and delivery address if applicable.

  • Payment information — payments are processed by our point-of-sale and payment providers (including Toast, Inc.). We do not store your full credit or debit card numbers on our own systems. Payment card data is handled by our payment processors in accordance with their own privacy policies and applicable payment card industry (PCI) standards.

  • Loyalty program information — your enrollment details, points or rewards balance, and redemption history.

  • Communications — messages you send us by email, text, social media, or through forms on our website.

Information collected automatically:

  • Device and usage data — when you use our website or mobile app, we and our service providers may automatically collect your IP address, browser type, device type and identifiers, operating system, pages viewed, links clicked, and the dates and times of your visits. If the app experiences an error, we may also receive a crash report to help us diagnose and fix the problem.

  • Cookies and similar technologies — we and our service providers may use cookies, pixels, tags, and similar technologies to operate our website and app, remember your preferences, analyze traffic, and measure the performance of our advertising. These may include analytics tools provided by our website platform (Squarespace), Google Analytics, and the Meta (Facebook/Instagram) Pixel.

  • Location — on our website and ordering platform, we may use your IP address to estimate your approximate location, for example to show you the nearest store. If you use the Tziki mobile app and choose to enable it, the app may also collect your precise (GPS) location to provide location-based features such as nearby-location alerts, live map views, and delivery estimates. You can enable or disable precise location at any time in your device settings.

  • Push notifications — if you use the Tziki mobile app and enable push notifications, we may send you notifications about your orders, offers, and news, and we may collect information about how you interact with them, such as whether a notification was delivered to your device and whether you tapped it. You can turn push notifications off at any time in your device settings.

  • Sensitive information. Some information you choose to share may be considered sensitive under certain privacy laws. For example, if you enable precise location, or if you enter dietary or dining preferences (such as allergies or foods you avoid) in an order note or your profile, this may reveal information about your health, accessibility needs, or beliefs. We use this information only to provide and personalize your experience — for example, to prepare your order the way you asked. You can remove precise location access in your device settings, and update or delete preferences you've entered, at any time. 2. How We Use Your Information

We use the information we collect to:‍ ‍

  • Process and fulfill your orders, including pickup and delivery;

  • Operate and administer your account and our loyalty program;

  • Send you transactional communications, such as order confirmations and receipts;

  • Send you marketing communications by email and text message, where you have opted in;

  • Personalize your experience, including remembering your preferences and suggesting items;

  • Improve our website, mobile app, menu, and services;

  • Measure and improve the effectiveness of our marketing, advertising, and push notifications, including by analyzing whether you interacted with a notification and whether you placed an order afterward;

  • Consent — you will only receive marketing text messages if you have expressly opted in. Consent to receive marketing texts is not a condition of any purchase.

  • Message frequency — message frequency varies. Message and data rates may apply.

  • No sharing of mobile information — no mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging opt-in data and consent will not be sold or shared with any third parties, except for service providers acting on our behalf to deliver messages.‍ ‍

Even if you opt out of marketing communications, we may still send you non-promotional, transactional messages, such as order confirmations.‍

4. How We Share Your Information‍ ‍

We do not sell your personal information. We share it only in the following circumstances:‍ ‍

  • Service providers — we share information with companies that provide services on our behalf, including our point-of-sale and online ordering provider (Toast, Inc.), our website platform (Squarespace), payment processors, email and SMS delivery providers, analytics providers, and advertising platforms. These providers are permitted to use your information only to provide services to us.

  • Toast — our online ordering, mobile app, payments, and loyalty program are powered by Toast, Inc. When you place an order, create a Toast account, or link a payment method, Toast also collects and processes your information under its own terms. Toast's handling of your information is described in the Toast Guest Terms of Service (pos.toasttab.com/terms-of-service) and the Toast Privacy Statement (pos.toasttab.com/privacy), which we encourage you to review.

  • Advertising partners — we may share limited information (such as data collected through cookies and pixels) with advertising platforms such as Meta and Google to measure and improve our advertising. You can limit this as described in Section 5.

  • Third-party delivery platforms — if you order Tziki through DoorDash, Uber Eats, Grubhub, or another third-party platform, your relationship and data on that platform are governed by that platform's own privacy policy, not ours. We receive from those platforms only the information needed to prepare and fulfill your order.

  • Legal compliance and protection — we may disclose information if required by law, subpoena, or legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud.

  • Business transfers — if Tziki or 209 Tzatziki LLC is involved in a merger, acquisition, financing, or sale of all or part of its business or assets, your information may be transferred as part of that transaction. We will take reasonable steps to ensure your information remains protected.‍

5. Cookies, Analytics, and Advertising Choices‍ ‍

  • Browser settings — most browsers allow you to block or delete cookies. Note that blocking cookies may affect the functionality of our website and online ordering.

We retain your personal information for as long as needed to provide our services, operate our loyalty program, comply with our legal obligations (including tax and accounting requirements), resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.‍

We use reasonable administrative, technical, and physical safeguards designed to protect your personal information, and we rely on established providers (such as Toast and Squarespace) that maintain their own security programs. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please protect your account credentials and notify us immediately at privacy@tziki.com if you suspect any unauthorized access.‍

8. Your Choices and Rights‍ ‍

You may:‍ ‍

  • Access or update your account and loyalty information through our ordering platform or by contacting us;

  • Unsubscribe from marketing emails or reply STOP to marketing texts at any time;

  • Request deletion of your personal information by contacting us at privacy@tziki.com. We will honor your request except where we are required or permitted to retain information by law.‍

Depending on where you live, you may have additional rights under applicable state privacy laws, such as the right to know, correct, or delete personal information, or to opt out of certain data sharing. To exercise any of these rights, contact us at privacy@tziki.com. We will not discriminate against you for exercising your privacy rights.‍

9. Children's Privacy‍ ‍

Our website, mobile app, and online services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information, please contact us at privacy@tziki.com and we will delete it.‍
